Multi-state sales tax compliance: your clients’ obligations, state by state

The challenge is rarely just a tax rate. Each registration brings a filing calendar, a data request, a responsible person and a payment or filing confirmation to retain.

The short answer

Multi-state sales tax compliance starts by determining where the business has obligations, then organizing each state’s registration, return, frequency and evidence. Physical presence, economic nexus and marketplace rules require separate review. A recurring task register helps run the process, while the applicable state authority and the professional determine the actual tax obligations.

Why obligations multiply across states

A business can have local premises, employees or inventory in one state and customers in several others. The question is not whether its headquarters has changed; it is whether facts create registration or collection duties in each jurisdiction. Keep the sales channel, type of sale and location evidence together before drawing a conclusion.

South Dakota v. Wayfair, decided in 2018, changed the physical-presence framework for sales tax. Economic nexus can create obligations without a local office. State thresholds and the transactions included in their tests are not interchangeable, so this guide does not publish a universal dollar or transaction threshold.

Marketplace facilitator rules add another layer. The platform may collect tax on facilitated sales, while the seller’s direct sales, registrations or other filing requirements still need review. California CDTFA’s marketplace guidance illustrates why platform collection and the seller’s entire compliance position are different questions.

Sales channels and taxable sales come before the calendar

An operational review separates gross sales, taxable sales, exempt transactions, returns and tax collected. The source of each figure matters: a payment processor’s receipts may not describe the shipping destination, exemption certificate or product category required by the state return.

For a fictitious distributor selling from a US subsidiary, one export can mix website sales, marketplace sales and wholesale customers. A useful working paper preserves the channel and exemption basis for each group. Reconcile totals with the accounting period, then flag missing certificates or unclear treatment for review before preparation.

Sales tax and VAT are different systems. A French parent’s VAT vocabulary is not a template for a US return. Local sales and use tax rules, exemption documentation and customer destination need their own analysis. The goal is an explained bridge between the sales data and the submitted return, not a translated tax label.

Who determines sales tax filing frequency?

The jurisdiction’s rules and assigned filing status determine the frequency. Monthly, quarterly and annual obligations can exist in practice, and the filing status can change. A registration notice or current portal record is stronger evidence than a copied calendar from the prior year.

New York’s general quarterly sales tax periods are not the same as federal calendar quarters. Its published reference dates are March 20, June 20, September 20 and December 20, subject to the applicable calendar adjustment. The state also describes other filing categories. Record the assigned category rather than deriving it from the name “quarterly”.

A software task’s recurrence and the legal reporting period are two fields. For example, scheduling a task every three months does not explain which months the return covers. Preserve the period start, period end, statutory date, preparation date and any change notice so a replacement team member can understand the next occurrence.

One register row per obligation, client and jurisdiction

The register is a working instrument for the firm. A single row labelled “sales tax” for a client active in several states conceals different owners, data sources and confirmations. Separate rows allow an incomplete state return to remain visible when another is already filed.

Use a source-backed rule for the statutory date and a separate internal cutoff for collecting the sales data. If the filing frequency changes, date the change and preserve the previous occurrences. The preparation team needs to know whether an earlier filing was done under the prior frequency rather than assume that the new rule always applied.

Keep other recurring duties separate

Payroll, income tax installments, property-related filings and business reporting can share the same operational register, but not the same legal assumptions. A Form 941 filing task and an employment tax deposit can have different timing. The IRS Form 941 instructions are the reference for that distinction; the payroll specialist determines the employer’s actual schedule.

The register’s purpose is to show the work, the owner and what is missing. Avoid making a sales tax status carry an unrelated payment, license renewal or group-reporting task. The estimated tax guide provides a separate payment framework, and the IRS calendar template covers federal reference dates rather than a complete state sales tax calendar.

Distinguish waiting for the client from unassigned work

A waiting status is useful only when it names the missing item, the requested person and the next review date. “Waiting for client” on every occurrence can hide a task that nobody owns. A simple handoff records the request, the period involved and which return cannot proceed without it.

Escalation is a team procedure: who reviews overdue data, who contacts the client and who approves the response. Define it before the statutory deadline. An internal follow-up policy does not establish that a particular product sends automated reminder emails, and no such email automation is assumed here.

On completion, retain the submitted return, filing confirmation and payment evidence as appropriate. A green task status should point to evidence and the reviewed period. If a corrected sales export arrives later, reopen the analysis deliberately rather than silently overwrite the file used for the original return.

Checklist when a client starts selling into a new state

Tax Workflow keeps monthly and quarterly recurring obligations with an owner and generates their next occurrence. That helps organize the firm’s confirmed calendar alongside return jobs and estimated payments. The state analysis and the filing remain professional work, supported by the authority’s instructions and the client’s evidence.

  1. Describe the activity

Identify locations, staff, inventory, destination of sales, platforms and direct channels.

  2. Request the professional review

Check current state rules for nexus, taxability, registration and exemptions.

  3. Record the confirmed obligation

Keep the notice, assigned frequency, reporting periods, portal and responsible preparer.

  4. Test the evidence trail

Reconcile one sample period from sales export to return and confirmation before scaling the workflow.

Common questions

Does selling online automatically require registration in every state?

No. Physical and economic nexus, taxable activity and marketplace rules need a state-by-state review. There is no single registration rule covering every seller.

Who decides whether a sales tax return is monthly or quarterly?

The relevant jurisdiction’s rules and assigned filing status. Retain the registration notice or current portal evidence and check changes over time.

Can a marketplace’s tax collection replace the seller’s review?

No. Facilitated sales, direct sales and the seller’s other registration or filing obligations may be treated differently. Review the applicable state guidance.

What should a waiting-for-client task show?

The missing item, its reporting period, the person asked, the owner of the task and the next follow-up. This separates a documented dependency from work nobody owns.

Does the IRS calendar download include every state’s sales tax dates?

No. It contains federal reference dates. Each state’s sales tax frequency and calendar need a separate, current source.
